A 23-year-old driver, Jazmin Patenaude, has been charged with dangerous operation of a vehicle causing death after a fatal crash in a Nanaimo parking lot last March. RCMP say the charge is due in part to modifications made to Patenaude's truck, which they believe were inherently dangerous given the busy parking lot environment. The modifications did not comply with safety inspections, increasing the potential risk of an accident.

Nanaimo RCMP says 23-year-old Jazmin Patenaude has been charged with one count of dangerous operation of a vehicle causing death. say the 85-year-old woman parked her car, exited and started walking toward the mall. At the same time, Patenaude drove out of her parking stall in a truck, turned left, and struck the woman, knocking her to the ground.

“It’s clearly a tragedy but it is important to remember that not every tragedy is a crime,” said Michael Mulligan, a lawyer, with“The particular offence of dangerous driving causing death would require the Crown to prove that the driver engaged in driving that was a marked departure of the standard of care of a reasonably prudent driver.”
