During a cabinet retreat on September 3rd, Mr. Carney initially expressed the need to maintain the Temporary Foreign Worker ( TFW ) program, citing employer demands for access to labor. However, a week later, he shifted his stance, emphasizing the need for reforms. The TFW program, originally designed for exceptional circumstances where Canadian workers were unavailable, had evolved into a system where exceptions became the norm.

This deviation has contributed to various issues that necessitate immediate attention. The fundamental intent of the TFW program was to address the scarcity of Canadian workers for specific job roles. Regrettably, the program experienced significant setbacks, leading to exploitation and instances of fraud. The policy of providing businesses with plentiful labor must be adjusted and reshaped. In order to revitalize the job market, the existing strategies must be refined to ensure it is tailored to match the requirements of the labor market. Some changes are underway to rectify the existing issues. The processing of applications for the low-wage stream of the TFW program has been temporarily suspended in 26 metropolitan areas with unemployment rates exceeding 6 percent, as per Employment and Social Development Canada. A more effective approach would be to eliminate the low-wage stream entirely, with very limited exceptions, and subsequently overhaul the rest of the program. This would address the issue directly rather than managing it. It is important to consider that the majority of temporary workers come to Canada through the International Mobility Program, including many former international students. This program does not have the same issues as the TFW program. Last year, the government implemented changes to both programs to curb the surge in temporary residents, which had fueled significant population growth between 2022 and 2024. These growth trends were driven by the increased supply of workers, which subsequently led to a softening in the job market. The root causes of the issues within the TFW program warrant careful examination. Under the TFW program, employers must obtain a Labour Market Impact Assessment (LMIA) to offer jobs, which is designed to certify that no Canadian worker can fill the role. This system has been abused and is a major problem. In many cases, salaries were not raised to attract workers, which resulted in the importing of low-wage workers from abroad, thus lowering Canada’s living standards. The program’s inherent flaws have contributed to significant issues. Prior to recent changes, temporary foreign workers, especially those in higher-wage, in-demand jobs, could accumulate substantial points towards permanent residency, which increased the value of LMIAs and led to their sale for tens of thousands of dollars. This created a situation where unscrupulous employers could easily exploit the system. Immigration lawyer Michael Greene highlighted the widespread abuses, citing instances of underpayment and even the creation of fictitious jobs. While there have been complaints, there has not been adequate enforcement and employers and consultants often avoided charges and prosecution. Even though there are caps in the numbers it is still challenging to rectify the problem and the LMIA system is broken. There isn’t enough enforcement to discourage abuses. It needs to be redesigned to get away from the idea of supplying businesses with all manner of workers and focus on the truly hard-to-fill, especially high-value jobs
