A Brampton man who pleaded guilty in the Mississauga street race that killed his 19-year-old girlfriend will be allowed to serve his sentence in the community, a judge has ruled.

“While I regard this as a very close call, I find it is not necessary to remove the offender from society,” Brampton Justice Bruce Durno said, explaining his reasons for not sentencing Daniyal Muhammad Khan to jail time.

“The impact on Arshad’s family has been devastating and continues to be so,” Durno said, noting as an aggravating factor that the crash happened as Khan was racing on a public roadway. The judge added that a breach will land Khan in jail. He will also be subjected to three years of probation, community service and an eight-year driving ban. He can only leave the house in the case of an emergency, for medical appointments and worship at a Markham-area Mosque.Initially, Arshad, a thriving York University student, was driving and racing a group of friends in another car at speeds of up to 100 km/h in a 60 km/h zone.
