A federal judge has dismissed a proposed $5 million class action lawsuit against Kraft Heinz Co. which alleged it falsely advertised that its Velveeta Shells & Cheese cups are 'ready in 3 1/2 minutes.'
ByPatience is a virtue, but a microwave minute can feel especially lengthy for anyone hungry. And for one woman whose patience wore thin waiting three and a half minutes on microwaveable macaroni and cheese, that time was minuscule compared to the eight months it took just to have her class action complaint tossed by a federal judge.
Kraft Heinz's motion to dismiss was granted without leave to amend and any pending motions have been denied as moot."Consumers are misled to expect the Product will be ready for consumption in a shorter amount of time than it really takes to prepare," the Ramirez claims in the suit that the mac and cheese products are"sold at a premium price, approximately no less than $10.99 for eight 2.39 oz cups, excluding tax and sales," which she said are priced"higher than similar products represented in a non-misleading way and higher than it would be sold for absent the misleading representations and omissions."
