She said IRAC argued that when the city rejected the application and opposed a staff recommendation to proceed, it failed to give sound planning principles behind its decision. “Even the most scrutinous review of the minutes of council’s Aug. 9, 2021, meeting, the minutes of planning board’s Aug. 3, 2021, meeting and the record as a whole, does not reveal sufficient reasons why council arrived at its decision to deny the appellant’s variance requests. To find otherwise would be to speculate.”

Mayor Philip Brown explained the reasons behind the original decision, saying numerous residents had concerns about increased traffic at a nearby elementary school. Brown himself had gone to the school in the morning and could attest to the traffic, including school busses and parental drop-offs, he said.

IRAC is clear in its decision that, when council goes against a staff recommendation, there is an added obligation to be clear during debates about why they are voting no.
