A B.C. Supreme Court judge has ruled that Rosa Donna Este must comply with a demolition order for the fire-damaged home she co-owns in West Vancouver. Este and her mother Mina Esteghamat-Ardakani purchased the property in 2003, but it was severely damaged by fire in 2015. The district issued a demolition order in 2020.
Owners of a fire-damaged home in West Vancouver have been ordered by a B.C. Supreme Court judge to comply with a demolition order. The District of West Vancouver obtained an injunction preventing co-owner Rosa Donna Este and others from interfering with the demolition of the home at 2668 Bellevue Ave. The home was purchased by Este and her mother Mina Esteghamat-Ardakani in 2003. Este stated she lived in the house until 2015, when it was extensively damaged in a fire.
It remained derelict for over five years. After receiving complaints about the property, the district issued a demolition order in December 2020. Este applied for a permit to build a new house in 2021, but her mother opposed it, and the district denied the application. Este then sought a judicial review of the decision and demolition order, arguing that her mother's consent was not required to build on the property. However, the B.C. Court of Appeal rejected her claim. Este has also previously taken her mother to court regarding property alterations. The matter is further complicated by Este's ex-husband Mehran Taherkhani, who has pending litigation on the property related to a family claim. Justice Francesca Marzari ruled that Este has not complied with the demolition order, demolished parts of the house without a permit, constructed on the property without a permit, ignored stop work orders, and interfered with district contractors
