ISG Senator Yvonne Boyer’s bill to combat forced or coerced sterilizations in Canada is headed for third reading in the Senate after being comprehensively reworked in committee in response to concerns raised last spring over potential unintended consequences. The amendment to Bill S-250—which was moved by Boyer at the start of clause-by-clause consideration at the Senate Legal and Constitutional Affairs Committee on Sept. 19—replaces all but the preamble of the original draft.
Aggravated assault carries a maximum penalty of 14 years imprisonment. As senior counsel Nathalie Levman explained, the “Supreme Court of Canada has already clarified that the law of assault applies to any medical procedure carried out on a person without that person’s consent,” as established in the 1988 Morgentaler decision, and that “both jurisprudence and the Criminal Code articulate the law of assault, including the meaning of consent in that context.
