A now 75-year-old man alleged to have sexually assaulted his stepdaughter between 1976 and 1983 will undergo another fitness hearing to determine if he is fit to stand trial. Via WS_DianeCrocker SaltWire

The inside of a Supreme Court of Newfoundland and Labrador courtroom in Corner Brook.CORNER BROOK, N.L. — A Northern Peninsula man who had been declared not fit to stand trial on charges that he sexually assaulted his stepdaughter 46 years ago was back in Newfoundland and Labrador Supreme Court in Corner Brook on Monday, Nov. 7.

In March, Justice George Murphy declared the 75-year-old man unfit to stand trial following a fitness hearing.During the hearing the doctor testified the man suffers from a mental disorder, described as a moderately severe major neurocognitive disorder that is likely Alzheimer’s type. In concluding that the man was not fit to stand trial the forensic psychiatrist also noted his low level of education, as well as other factors, negatively affect the man’s cognitive deficits.

During Monday’s appearance Murphy said the court has to conduct another fitness hearing to determine if the man is fit to stand trial.
