Prior to the rampage, Banfield asked her brother, James Banfield, and brother-in-law Brian Brewster to use their firearms licences to buy ammunition for the killer. All three were subsequently charged with unlawfully transferring ammunition to the shooter in the month before the shootings. Banfield said she gave statements to the RCMP on April 19, 20 and 28 of 2020. She also performed a re-enactment for an RCMP investigator in late October 2020.
“The RCMP gave the plaintiff appropriate and lawful cautions on every occasion that the RCMP spoke to the plaintiff about her involvement in assisting the perpetrator in acquiring the ammunition used during the mass casualty,” MacPhee wrote.“ There was no duty on the RCMP to inform the plaintiff of her right to counsel before or during her statements to the RCMP on April 19, 20, 28, July 28, nor on Oct. 23, 2020, as she had not been arrested and or detained.
MacPhee said the decision to proceed with the prosecution was within the discretion of Nova Scotia’s public prosecution service.
