Mowachaht/Muchalaht First Nation is seeking aboriginal title to more than 430,000 hectares of land in the Gold River-Tahsis area, and compensation for forestry operations on its traditional lands

The head chief of a Vancouver Island First Nation has filed a civil claim against the province on behalf of his people for aboriginal title to more than 430,000 hectares of land in the Gold River-Tahsis area, and is also asking for monetary compensation for forestry operations on their traditional lands.

“Our people, the Mowachaht/Muchalaht, have endured many hardships since first meeting Captain Cook,” he said. “The natural resources of our people, of our lands, have been taken — and certainly not in according to the permission that one would normally seek, if they wanted to extract things from our territory.”

Lawyers with Woodward & Co. filed a claim in B.C. Supreme Court on behalf of Maquinna at the Victoria courthouse on Thursday morning, seeking aboriginal title over about 430,000 hectares of lands and waters between Tahsis, Yuquot and Buttle Lake, as well as monetary compensation from the revenues generated by provincially approved forestry operations and other damages.

“The exploitation of territory and the natural resources has significantly impacted Mowachaht/Muchalaht people,” he said, adding that logging and other industrial activity has had “devastating” effects on the ecosystems on their lands.
