Edmonton man guilty of assault in 2017 road rage attack that broke woman's arms
The trial of Jared Eliasson hinged on one key question: was he the person who attacked Chelsey Schendzielorz with a crowbar outside her car on that winter morning in 2017?
However, Germain declined to convict on the attempted murder charge, saying the Crown hadn’t proved Eliasson intended to kill Schendzielorz in a fit of road rage. The attack happened in her driveway shortly after she honked at the driver of a Pontiac Wave blocking a right-hand turn at 76 Avenue and 87 Street — a block and a half from her home. Eliasson, the driver, was delivering newspapers in the area at the time.
While Schendzielorz identified Eliasson in the prisoner’s dock, Germain acknowledged that dock identifications have been a factor in wrongful convictions — a mere “acceptance that the police got it right.” Eyewitness identifications are often unreliable, Germain said, especially in high-stress situations.
