Just a month before he killed two pedestrians and himself in a high-speed crash in Etobicoke last week, Omar Sinclair Frederick Downey started serving a two-year driving prohibition, courts documents show.

The 36-year-old driver — identified by a source close to his family — was not legally allowed to be behind the wheel anywhere in Canada.

He and both pedestrians died at the scene of the crash. One of the pedestrians has since been identified asThe reason for Downey’s medical license suspension is not clear; police said witnesses to the prior crash, about 2.5 kilometres away on Lake Shore near Eighth Street, thought he “was having a seizure.”

It’s difficult for police to effectively enforce license suspensions and prohibitions if the drivers themselves don’t see the incentives of abiding by the rules, said Eric Dumschat, legal director at MADD Canada. “There’s no winning in it,” he said. “You could be literally the best driver ever but if you’re driving suspended you don’t have insurance. What if someone else hits you? What if you hit something? Things happen.”
