A special prosecutor has stayed the charges against the last of four Mounties arrested in connection with the Surrey Six murder investigation, citing medical health concerns for the officer.

The last of four Mounties facing trial in connection with the Surrey Six murder investigation has had his charges stayed due mainly to the fact he is suffering from cancer and his prospects of recovery are uncertain.

Three other officers who were also charged – Derek Brassington, David Attew and Danny Michaud – pleaded guilty in January to a number of offences and received conditional sentences. He said the Crown’s principle consideration was that lawyers for Johnston had presented the Crown with credible medical evidence of a recent and recurring diagnosis of Hodgkin’s lymphoma, a form of cancer, for the accused.

Although a recent court ruling found the Crown was not responsible for the considerable delays in the case, Considine said the time which has elapsed remains a revenant consideration in assessing the public interest issue.
