A 70-year-old man convicted decades ago of murdering a woman on the day she was scheduled to testify against his brother will not be granted compassionate release, federal prosecutors announced Wednesday.

Former Gettysburg resident Willie Tyler is serving life in prison for witness tampering by murder, the Department of Justice said. Prosecutors said Tyler brutally murdered the Carlisle-area woman — a confidential police informant — in 1992, on the day she was going to testify against Tyler’s brother David Tyler.

Willie Tyler was acquitted in 1994, but found guilty two years later when the case was adopted for federal prosecution, prosecutors said. The U.S. Court of Appeals for the Third Circuit overturned his conviction, but then he was convicted again in 2000. The conviction was overturned again in 2013, and Willie Tyler was convicted a third time in 2017.

After a flurry of appeals, Tyler’s conviction was solidified in May 2021 when the U.S. Supreme Court declined to take on the case.“Federal law permits federal prisoners to seek a sentence reduction and immediate release—commonly called compassionate release—if they can establish extraordinary and compelling reasons,” federal prosecutors said Wednesday, noting that a federal judge ruled Tyler did not meet that threshold.

While making his ruling, Judge Christopher Conner reportedly said, “Tyler is serving a congressionally mandated life sentence for his role in the brutal murder.”
