B.C. ready for court battle as Alberta proclaims turn-off-the-taps law

Alberta has proclaimed a law that allows it to slow the flow of oil and gas to B.C. For its part, the B.C. government says it is ready to fight in court right away.

The law gives the Alberta government the power to impose licences on companies exporting petroleum products and place restrictions on licence holders. It gives the province the power to limit the allowable daily quantities of petroleum products shipped, the method of shipment and point of export, and length of time a licence is in effect.

“Our materials are all prepared,” Eby said Tuesday. “And the court was clear with us, when we were there already on this law, that it needed to be proclaimed into law before we were in Alberta court.”In February, a B.C. government court challenge of Bill 12 was shot down by a Calgary judge who said B.C. took the case to court prematurely.

Kenney said he had no immediate plans to cut reduce energy shipments to B.C., but it would give his government the ability to use the law if it felt it was necessary. “While it may serve well during an election campaign, where you are trying to instil this kind of power and strengthen its bluster, legally, he can’t do it,” Weaver said.
