That application asks the court to order that the 2022 election be kept from proceeding on its scheduled date of May 7 and that it should use single-member districts when it does take place.Under the single-member district system that Elizondo’s lawsuit and the injunction, Spring Branch ISD would be divided into geographical zones and assign trustees to each geographical zone for which only the people living in that geographic zone could vote.
Adding, “assuming the Court determines that SBISD’s current at-large system is permissible after a trial on the merits, there will be no need to hold that election as a single member district election as requested by Plaintiff.” Adding, “Allowing the current board to remain through trial will best assure the continuity of the school district’s defense in this suit. This is in the school district’s best litigation interest.”
