Court heard Wapass was part of a group trying to enter the home, where one of them lived, through a back entrance. Jimmy, then 21, also lived there with his grandmother; they used the front door. Jimmy kicked Wapass several times in the head before picking up the axe. Wapass got up and Jimmy hit him in the back, then swung and hit him repeatedly, including in the head. He then went inside to play video games and told his grandmother he had beaten someone.
She also considered that Jimmy chose to return with a weapon and engage in a confrontation, and later watched Wapass stumble out of the yard, obviously injured, then returned inside instead of trying to get him help, she said.
