Adora Perez was accused of murder after a pregnancy loss. She has already served four years in jail.
The original murder charge still stands because the ruling found that Perez’s plea was invalid due to a new appellate case,, which holds that a judge cannot accept a negotiated plea that is factually impossible. Perez was accused of murder in December 2017 after she gave birth at 37 weeks to a stillborn fetus and admitted to methamphetamine use during pregnancy.
. “With reproductive rights under attack in this country, it is important that we make it clear: Here in California, we do not criminalize the loss of a pregnancy.”” the decision to vacate the 11-year prison sentence and conviction against Perez. “This decision is a good first step towards affirming what we know to be true, no woman should be penalized for the loss of her pregnancy,” he said.
