It is the best of times for whistleblowers—greater opportunities for financial reward and protection against retaliation, and the worst of times—thanks to chaos in federal government.

In early 2018, I was asked to meet with the Criminal Division of the U.S. Department of Justice regarding a whistleblower complaint I had filed with certain federal agencies. On the one hand, I was heartened to learn that my complaint had been referred to DOJ for criminal prosecution. Far too often corporations involved in blatant criminal fraud are not criminally prosecuted.that a former DOJ lawyer had been selling information about corporate whistleblower complaints to the target corporations.

Whistleblowers are still subject to many dangers and altogether new risks are popping up virtually daily in the Trump era. Just when whistleblowers were feeling reassured, in June 2018, the SEC voted to propose amending the rules governing its whistleblower program tothe monetary award that a whistleblower could receive at $30 million—regardless of the size of the fraud or the money ultimately recovered by the government.
