Both men, who were 18 at the time of the shooting, have been found guilty of second-degree murder in the shooting death of Jonathan Gayle-West.

When Jonathan Gayle-West joined a new high school in Grade 10 and tried out for the basketball team, he was clearly a leader and so well-liked that he was voted captain that year, his then coach Jim Stewart recalled.

After the verdicts were read out, Gayle-West’s family, who were present throughout the trial, shed tears and clasped hands. But, in closing arguments defence lawyers for both men pointed the finger at each other as the sole killer. “Would you have the guts to turn in your childhood friend for a shooting?” Herscovitch asked the jury, urging them not to convict his client out of disgust that he would flee alongside the shooter and not call 911.

The men remained together after the shooting, with one man retrieving the other’s shoe from the car and both returning to search for something with a flashlight. Later that night, the two men and a friend, Adil Zeno, went to a Scarborough motel with a bottle of Hennessey. Except, it turned out that Zeno was a self-described pathological liar who did not kill Hees and whose version of events did not match up with the forensic evidence. The charges against all four including Zeno were dismissed after preliminary inquiries.While he did go to the motel with the two men that night, he was intoxicated and could not clearly remember what they told him about what happened in the car, they argued.
