A new executive order by President Trump aiming to revoke birthright citizenship for children born to undocumented immigrants is facing legal challenges. Immigrant advocacy groups argue the order violates the 14th Amendment, while the Justice Department defends it, claiming it addresses national security concerns.

’s order, “Protecting the Meaning and Value of American Citizenship,” that seeks to make it so that that children born in the United States to parents who are undocumented immigrants or who are in the country on a temporary legal basis will not automatically be United States citizens.“Monica,” a Venezuelan-born medical doctor now living in South Carolina under temporary protected status, is one of the five represented in the case.

The complaint, filed by immigrant advocacy groups Casa, Inc. and the Asylum Seeker Advocacy Project, called the executive order, a “flagrant violation” of the Citizenship Clause in 14th Amendment of the Constitution. The Citizenship Clause states that “all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.
