The bill throws together many elements, but some commentators have missed the really big one. The minister himself skirted past it in Second Reading debate in theSections 13 to 17 of the bill would allow the minister to designate all of the Halifax Regional Municipality as a “special planning area.”
No public notice of a proposed land development would be required if a developer decides to go straight to the minister. Not even HRM council or staff would be entitled to notice or consultation. Indeed, not even the minister’s recently established Executive Panel on Housing would have to be in the loop or make a prior recommendation.No technical review would be required to ensure that components like water, sewer and traffic infrastructure line up with a proposed development.
That won’t happen because of this bill. HRM’s current Municipal Planning Strategy actually provides lots of room to grow. This bill won’t address labour shortages, supply chains, burdensome interest rates, costs of materials and lack of incentives for affordable housing.What it could do is divert local planners and engineers from shepherding through legitimate and much-needed affordable-housing projects.
And if the minister’s approved developments somehow cause damage to neighbouring properties, it’s too bad. Those properties are “deemed to be not injuriously affected” .
