Anthony Comstock was was perhaps the biggest proponent of what came to be known as 'the nanny state.' So why did a supposedly conservative judge cite him in that decision to outlaw an abortion drug?
Kacsmaryk writes “The Comstock Act declares ‘every obscene, lewd, lascivious, indecent, filthy or vile article, matter, thing, device, or substance’ to be ‘nonmailable matter’ that ‘shall not be conveyed in the mails or delivered from any post office or by any letter carrier.’”
Prior to the revolution one pessimist predicted Congress would make short work of states' rights and individual freedom, it didn't take long before Congress proved him right with Prohibition and other sweeping national laws Comstock, who lived in Summit for most of his adult life, was also an opponent of demon alcohol. He had plenty of allies in that crusade as well. The National Prohibition Party was founded in 1869 and the Women’s Christian Temperance Union shortly thereafter.of that form of what was derided as “comstockery.” But if the reaction to Kacsmaryk’s decision is any indication, comstockery still has a place in the Republican Party.
But there are always people who can’t leave well enough alone. Kacsmaryk is one of them. Like Comstock, he decided to take what should be a state issue andWorse, he relied on the nanny state to do so. Most Republicans oppose the over-regulation of drugs by the Food and Drug Administration. Not Kacsmaryk. In his ruling he spends page after page micro-managing that pillar of the nanny state.
