State Comptroller Glenn Hegar says his office has already approved more than 300 applications this year for Chapter 313 tax breaks.

In a statement, Comptroller Glenn Hegar defended his staff and called the legal challenge “a frivolous attempt to get the Texas Supreme Court to force my office to put even more resources toward the program in the final two weeks of its existence.” The law gives Hegar’s office 90 days to review applications and the agency notified the companies it wouldn’t be able to act by the law’s expiration.
Hegar said his office will certify more than 300 projects this year alone. Chapter 313 is the section in state tax code that gives school districts authority to limit taxes they collect as a way to encourage business investment. The law’s expiration set off a scramble by companies filing applications for tax breaks on future projects.
The companies argue the state’s failure to certify their projects is jeopardizing $773.5 million in proposed capital investments in wind and solar electric-generating facilities in Texas. They stand to lose $27 million in tax incentives, according to their court filing.
