Starting Nov. 1, Texas renters struggling financially because of the pandemic will become more vulnerable to evictions, as officials curtail two key tenant protections.

. The number of evictions filed in the 2021 fiscal year was 72 percent lower than during the fiscal year preceding the pandemic. That has an outsized impact for tenants because having an eviction case filed — regardless of the resident's outcome — serves as a black mark on tenant screening reports. Because such reports typically only list whether a case was filed, even if the tenant wins a case or the case is dismissed,.

"If there's a lawyer on the other side, that changes the calculus of how you proceed," he said. The coalition pushes for the right to counsel in various types of civil cases including eviction, health care and domestic violence trials.A Houston dad died of COVID, and his family faced eviction. The region’s rent relief isn't enough.

The order has not always been carried out, since different justice of the peace courts implemented it differently. Some judges only asked landlords if they wanted rent relief instead of checking to see whether they had applied for it. Members of the Eviction Defense Coalition sued multiple judges,. Nonetheless, the order provided grounds for tenant lawyers to ask for time while rent relief applications were being processed.
