‘Strong suspicions’ by police that Vincenzo (Jimmy) DeMaria is a Mafia boss are not enough to send him packing, Justice James Russell concluded

Alleged Toronto Mafia boss Vincenzo DeMaria has retained his remarkable record of success fighting government agencies trying to pen him in, pin him down or kick him out.

Before he could be deported, however, DeMaria appealed the decision to the Federal Court, as his habit. After shooting a man dead at a Toronto grocery store in 1981 — the victim owed him money but refused to pay — he never could obtain citizenship and he has remained vulnerable to deportation and to lifetime parole ever since.

The evidence, DeMaria’s lawyers argued, amounts to “nothing more than unsubstantiated police opinions and newspaper reports.” DeMaria said he had met both men when they served time together in prison in the 1980s but had no current relationship with them. His lawyers argued police may have spotted them all at the same event but no one saw them talking together.

And some of the facts presented at the hearing, Russell wrote, are “tenuous evidence, to say the least.”
