'The SEC seeks to certify the Court’s holding that Defendants’ 'Programmatic' offers and sales to XRP buyers over crypto asset trading platforms and Ripple’s 'Other Distributions' in exchange for labor and services did not involve the offer or sale of securities under SEC v. W.J. Howey Co., 328 U.S. 293 ," the regulator said in the letter.

The SEC proposed a briefing schedule to file its opening brief on Aug. 18, which is two days after the defendants’ response to the letter is due.© 2023 The Block Crypto, Inc. All Rights Reserved.
