Jacob Dominguez was unarmed when he was shot by Officer Michael Pina; police said suspicion in an earlier armed robbery led the officer to fear Dominguez was reaching for a gun.

SAN JOSE — Five years after 33-year-old Jacob Dominguez wasduring a high-risk traffic stop — on the belief Dominguez was reaching for a gun that never materialized — a federal excessive-force trial is underway to assess the shooting officer’s liability in the death.

“To stop at that position was a poor tactic,” Scott DeFoe, a use-of-force consultant with an extensive background with the Los Angeles Police Department, said in court Tuesday.During the first two days of trial, Pina — who has since been promoted to sergeant — and other officers testified about how they had been tracking Dominguez and at least two other people they suspected in the armed robbery of an Arco gas station minimart at Quimby Road and Capitol Expressway on Sept. 12, 2017.

He described a brief exchange in which he said Dominguez dared him to shoot, and he responded “Don’t give me a reason.”
