'There’s a lot of weirdness here.'
San Franciscolaws have created a world where Proposition K — originally intended to raise taxes on e-commerce giants such as Amazon to pay for guaranteed income programs — could not only appear on the November ballot, but also pass because its proponents can't use their proponent statement to say they messed up.
"I’m worried enough about it passing that I will spend a lot of my time talking about it, so voters know not to vote for the measure," said Sharky Laguana, the city's Small Business Commission President, who opposes Prop. K."It would be frustrating after all this work to have the measure pass." As it stands now, both Laguana and the Tenants and Owners Development Corporation — the sole funder for Prop. K — want to see the initiative fail because it appears its language won't even apply to Amazon. Laguana explained that the initiative language alters taxes on retail and trade, but because more than 80% of Amazon's revenue in the city comes from cloud services, it's taxed in the city for information."The threshold for the tax to kick in is $2.
The city's department of election said that TODCO is working to obtain a court order to get the measure removed from the ballot. Theis unambiguous in stating,"Once submitted to the Department of Elections, measures proposed by initiative petition may not be withdrawn." TODCO did not respond to an SFGATE request for comment.
Laguana said that TODCO is going to leave its proponent statement blank so the ballot only contains an opposition statement penned by Laguana himself.
