Law Firm Challenges Proposed Capital Gains Tax Hike Before Parliament VoteA B.C. company, represented by Thorsteinssons LLP, is seeking an injunction to prevent the Canada Revenue Agency (CRA) from enforcing a proposed capital gains tax increase before it is passed by Parliament. The Liberal government's spring budget proposal aims to raise the tax rate on capital gains to two-thirds from one-half for both companies and individuals earning above $250,000. Although Parliament is prorogued, the CRA stated it must act as if the change will take effect unless otherwise instructed. The law firm argues that the proposed change has not yet been approved and urges the Federal Court to order the CRA to administer the law in its current state, which taxes capital gains at half the rate.
