Under Ontario law, the College was established to set standards for practice and issue licences but Peterson believes they have ventured into policing speech unrelated to the practice of psychology.Article contentThe Notice of Application filed by Peterson’s legal team seeks “an order, certiorari quashing the decision of the Inquiries, Complaints and Reports Committee of the College of Psychologists of Ontario” which was dated Nov. 22, 2022. A certiorari order is a review by a higher court of a lower court ruling. Peterson has filed with the Ontario Superior Court of Justice for a review of a ruling by the College, which acts as a quasi-judicial body backed up by a legislative framework governed by the province of Ontario.Jordan Peterson will use Charter challenge over being disciplined for tweets The main crux of the argument, laid out in full below, is that the decision and many of the policies and bylaws of the College are infringements of the Section 2 rights guaranteed in the Charter of Rights and Freedoms. Section 2 states that everyone has, “freedom of thought, belief, opinion and expression, including freedom of the press and other media of communication.” By policing Peterson’s statements, on social media and other places, in ways that have nothing to do with the practice of psychology, his legal team argues that his Charter rights are being violated.Article content
