The pair raised a number of grounds of appeal. One alleged that the actions of former Vancouver police Det. Jim Fisher, who was the lead investigator on the attempt to obstruct justice count and had a large number of interactions with the victims, helped lead to their convictions. They argued that non-disclosure of certain materials deprived them of the ability to make a full defence, rendering their trial unfair. They also claimed that the judge made errors in principle in managing disclosure issues.Article content

The appellants also received statements provided by the victims in the police investigation into Fisher’s conduct and knew that Fisher had been charged with a number of offences.
