William Robert Companion's sexual assault conviction and sentence appeal has been dismissed in P.E.I. Supreme Court. - SaltWire Network File PhotoCHARLOTTETOWN, P.E.I. — A Miscouche man's sexual assault conviction and sentence appeal has been dismissed in P.E.I. Supreme Court.
Cann found no errors in principle of MacKay's treatment of these claims. For instance, Cann said there was no evidence before the trial judge regarding the amount and duration of alcohol consumed by the complainant and his ability to perceive and recall what happened. Even so, in her decision, MacKay found that the complainant's testimony was consistent and"not substantively challenged by the defence despite detailed cross-examination.
At trial, the complainant responded that he was only"a bit uncomfortable" and not"super upset about it." Cann noted that the statement to police wasn't entered into evidence at trial.
