Superior Court Justice Hugh McLean wasted little time Thursday in dismissing the application from Hillier’s lawyer, David Anber, with the veteran judge delivering his ruling moments after hearing arguments from Anber and Crown prosecutor Tim Wightman.
Wightman filed as evidence a police investigative report outlining the potential disruptions the city faces from the incoming “Rolling Thunder” motorcycle protest expected in Ottawa this weekend. “Just because they were against vaccine policies, that doesn’t form the basis of the alleged criminality,” Anber told the judge. “It was the manner in which they protested that led to the charges.”
“Why does simply talking about these issues constitute a substantial likelihood of reoffending?” Anber asked at one point.Article content He also incited his followers to flood non-emergency lines during the height of the protest and ensuing mass arrests, Wightman said. McLean also rejected the argument that the court-imposed social media restriction infringed on Hillier’s right to freedom of expression, either as“We have the evidence that, for a substantial period of time, Mr. Hillier has not obeyed provincial offences. He has also encouraged others to break those laws,” McLean said. “Those restrictions are entirely reasonable and fitting, given these circumstances.
