An off-duty sheriff’s deputy from Vermont was shot multiple times by police in New York after he was involved in a gunfight with another group of people early Sunday morning, police said.

Montagnino said he believed seven or eight shots were exchanged in the gunfight, and the deputy shot the Utica man who drew his weapon. Montagnino said officers ordered him to drop the gun at least eight times, but the deputy “ignored” the commands. “So it doesn’t mean that he was shot 10 times, it simply means that there were 10 wounds. It’s certainly possible that he was shot half that number or even less,” Montagnino said. "If a bullet penetrated an arm and lodged in the chest, that could be three wounds from one round.”

Montagnino said it's the first time in nearly 30 years that an on-duty Saratoga Springs officer discharged their weapon.
