There are two candidates on the Nov. 8 ballot running to be the next San Diego County Superior Court judge in Office No. 35: Deputy Attorney General Mike Murphy and Assistant U.S. Attorney Rebecca Kanter. Here are Murphy’s answers to an 11-question survey The San Diego Union-Tribune Editorial Board emailed out.A: I have extensive experience litigating cases in California’s court system. I began my career as a defense attorney representing citizens accused of crimes in our Superior Courts.

Q: Do you believe the state and U.S. constitutions are evolving documents or does that give judges too much leeway in arriving at their decisions? What is your judicial philosophy in interpreting existing laws? Q: Inmates die at a higher rate in San Diego County jails than in comparable California jails. Should this affect any of your decisions?

With respect to the closely related question of whether California’s cash bail system should be eliminated altogether, that issue is the subject of ongoing legislative debate and potential future litigation. That being the case, it would be inappropriate under Canon 5B of the Code of Judicial Ethics for a judicial candidate to comment on the matter.
