The federal justice minister announced a new commission to review potential wrongful convictions, aimed at supporting racialized and Indigenous Peoples who are disproportionately represented in the criminal justice system. Bill C-40, named after David Milgaard who served 23 years for a crime he didn't commit, establishes an independent commission to handle these reviews, promoting a fairer and more efficient process. The minister emphasized the serious injustices imposed by wrongful convictions and highlighted the underrepresentation of racialized individuals and women in previous overturned cases. The new legislation will provide financial and logistical support to individuals claiming wrongful conviction, aiming to create a more equitable playing field.

Bill C-40, named after David Milgaard and his mother, Joyce, will move the review process for cases away from the justice minister and give it to an independent commission. The government says the new commission will make the process easier, faster and more fair for the potentially wrongfully convicted.
Justice Minister Arif Virani said that while wrongful convictions are rare, they impose grave injustices on accused individuals, their families and victims of crime. But none of those cases involved women, and only seven included racialized people, despite their overrepresentation in the criminal justice system.
