Following an Ontario court ruling finding inmates' charter rights were being violated, the federal government abolished solitary confinement in 2019 and replaced it with structured intervention units.
“If human rights require strict limits on individualized solitary confinement, it just can’t be right that it’s legal to perpetuate the very same kind of in-cell isolation en masse, like across an entire unit or entire jail, particularly where the rationale for that is one of institutional or administrative convenience.”
“There’s no limit on the amount of time people can spend in this situation,” Wildeman said, adding there is no clear standards for what it would take for a person to be released. “Cessation of programming continues to gravely affect mental, physical, and spiritual well-being among provincially incarcerated people, and will likely make community re-entry harder,” the report reads.
“Some facilities were subject to a period of quarantine, which we observed was itself synonymous with solitary confinement."She also noted how Indigenous people, African Nova Scotians and marginalized groups continue to be overrepresented in custody. Wildeman did note, however, some positive steps have been taken by the provincial government within the past year, such as policy changes to limit strip searching and investments in bail bed programs.
