Conditional sentence, probation for luring and kissing girl 'demonstrably unfit'

Former Cole Harbour teacher Sean Patrick Palmer, left, leaves Dartmouth provincial court with lawyer Ron Pizzo on Dec. 9, 2022, after being sentenced for luring and sexually assaulting a 14-year-old student in 2020. Palmer, who now lives in Ontario, received an eight-month conditional sentence of house arrest, followed by three years' probation. - Steve BruceHALIFAX, N.S.

The prosecution, in its notice of appeal, the prosecution said the sentence imposed by Sarson was “demonstrably unfit” and should be set aside and replaced by jail time of 18 to 24 months on each count. RCMP began investigating March 6, 2020, after friends of the victim told school administration Palmer had had inappropriate contact with the girl.

Palmer's sentencing was initially set for November 2021, but the hearing was postponed after Judge Rickcola Brinton, who had accepted the guilty pleas, went on leave for health-related reasons. The case was assigned to Sarson last summer. The defence then filed a pair of motions claiming Palmer’s charter rights had been violated.
