Monique Rodwell and three of her adult sons filed a federal civil rights suit last week stemming from a June 2021 incident, naming Mayor Ras Baraka and other officials and law enforcement officers as defendants.
There was no audio during the initial portion of the videotape when authorities said the officers identified themselves. The suit alleges that the audio was deliberately deleted to hide that the officers never identified themselves.
“We believe the downgrading of the charges gives validity to our initial demand that the charges be dropped,” said POP founder and chairman Lawrence Hamm. “We believe that this was a case of racial profiling.” Still, he spent more than a year in jail before his release in July at the request of the Essex County Prosecutor’s Office. In September, prosecutors downgraded the assault and other charges against him and his brothers from third-degree felonies that could have resulted in years-long prison sentences to disorderly person offenses with maximum fines of $1,000 and up to 180 days in the county jail.

So, Hardaway filed a motion in State Superior Court in Newark to dismiss the charges against him based on the assertion that the altercation and his subsequent indictment would not have occurred if officers hadn’t racially profiled his brother. Hardaway also asserted that prosecutors had abused their discretion by presenting the case to a grand jury.
