Hardaway’s attorney Mark Melton said his client did not receive a 30-day notice to vacate, as required by the CARES Act, and that someone at the Dallas county court of Justice of the Peace Margaret O’Brien falsified an official notice of the woman’s re-set hearing date after he asked to see a copy of it in the court’s records.the judge denied any wrongdoing by her court and said she is prohibited from commenting on active litigation.
Hardaway learned of the missed hearing on Aug. 4 when she was served with a 24-hour notice to vacate after O’Brien’s court issued an eviction in the landlord’s favor, according to the lawsuit. One day later, Hardaway filed a motion to stop the eviction, which O’Brien denied that same day.
