JOHN'S, N.L. — A Marystown-area woman sentenced last summer for stabbing another woman in the arm has been acquitted, after both Crown and defence told the Court of Appeal the trial judge should not have convicted her.“An important aspect of the legal system is the duty of the Crown to seek justice rather than merely securing convictions. The complainant said she thought the woman had only punched her until a few minutes later when she saw blood and realized she had been stabbed in the arm. She said her brother had been stabbed in the groin but refused to go to hospital, and tried to talk her out of going as well. She eventually went, but lied to the doctor about the injury, telling him first she had gotten cut while trying to get her cat off the roof, then claiming a boyfriend had assaulted her.

The Court of Appeal determined Porter had misapprehended the evidence, which resulted in him finding facts that were not supported by evidence and ultimately concluding beyond a reasonable doubt that Warford was guilty.
