A man who has spent his entire adult life behind bars for raping and killing an 86-year-old woman in 1986 will get a chance to argue for a new sentence.
The fire, though, burned itself out and the husband survived. The husband died months later, but the suspects were not charged in his death. Terry’s arguments were based on the prevailing court decisions at the time, the 2017 New Jersey Supreme Court, which incorporated the U.S. Supreme Court 2012 Miller decision, which give inmates serving life sentences they began as juveniles a meaningful shot at parole.
Comer hearings do not focus on guilt, but defendants must prove to a judge they have matured and been rehabilitated.
