CCTV footage captured the confrontation, showing Carver writing sexual slurs on the sidewalk in chalk and appearing to be intoxicated. The video captured Van Dyke pushing Carver, who fell backward and then retaliated with his cane. Following a struggle, Van Dyke struck Carver with the cane, causing his fatal head injury. The judge ruled that the force used by Van Dyke was excessive and not proportionate to the threat posed by Carver. Van Dyke, who has a previous criminal record for assault and other offenses, apologized to Carver's family and the court during the sentencing hearing. However, Judge Oulton expressed skepticism about the genuineness of his remorse, stating that it lacked a full acceptance of responsibility. Van Dyke was taken into custody by sheriffs after the sentencing.
