An Ahousaht man has been sentenced to two years in prison for sexually assaulting his girlfriend’s adult daughter in 2021. Michael Anthony Titian had pleaded guilty on the first day of his trial to sexually assaulting the 23-year-old woman in her home in September 2021 after a night of drinking with his girlfriend and her daughter. He was sentenced in B.C. Supreme Court in Port Alberni in October, and the judge’s sentencing decision was recently released.

The woman, whose identity is protected by a publication ban, said she woke up on the couch feeling Titian’s penis inside of her. She rebuffed Titian, who was 52 at the time, and went to the washroom where she discovered she was bleeding. When she went to her bed to go back to sleep, Titian came to her and tried to touch her. She swore at him and told him to leave and he did. Titian’s DNA was found in a sample of semen taken from the woman’s anal area. “This is a serious sexual assault. This is a violation of X.X.’s person. She was a ­vulnerable person — she was asleep. It is unacceptable and it is criminal,” Justice Joseph Doyle said in his sentencing decision. The woman, her mother and several family members gave victim impact statements. Her uncle, who, like Titian, attended residential school, shared the pain it brought to his life and his perspective on how the Indigenous community can deal with that legacy, stressing the need for women to be protected, Doyle wrote. Doyle accepted a joint sentencing submission from Crown and Titian’s defence lawyer of two years in a penitentiary followed by three years on conditions. Doyle considered as mitigating factors an apology given by Titian the morning after the assault and a second apology given when he pleaded guilty in court.
