The Crown was seeking a suspended sentence and a term of three years probation, while the defence was calling for conditional discharge and two years probation.would mean he was not officially convicted of the crime.Gouge noted that Barber had already committed a sexual assault that occurred on Sept. 16, 2021, just two months before the bus assaults occurred.

“Although the events of Sept. 16, 2021 did not lead to a ‘conviction’ , the conduct in question was clearly contrary to the Criminal Code,” said Gouge.
