Michael Lannigan was sentenced to time served after pleading guilty to exposing himself at Sault Area Hospital and violating probation conditions. He was placed on a further 24-month probation order.
Just four days after being placed on probation for a year, Michael Lannigan began to violate the court order issued on October 21st. In less than two weeks, he repeatedly breached the conditions, including two instances where he appeared at locations prohibited to him. One such incident occurred at the Sault Area Hospital on November 4th, resulting in Lannigan being charged with causing a disturbance and committing an indecent act in a public place.
On Tuesday, the 50-year-old pleaded guilty to six charges, including exposing himself to staff and patients in the hospital's emergency room. Lannigan was also convicted of four counts of violating probation and a single charge of breaching an undertaking. Ontario Court Justice Heather Mendes heard that he failed to report to his probation officer on October 25th and breached his order by going to Walmart on October 29th. He was under an undertaking not to attend SAH except for legitimate medical reasons. Around 3 p.m. on November 4th, city police responded to a 911 call about a man exposing his genitals multiple times in the emergency department. Upon arrival, officers found Lannigan had left the facility but apprehended him on Great Northern Road. In a news release following his arrest, police stated an investigation indicated the accused 'had pulled their pants down and exposed their genitals and buttocks while walking in front of multiple people, including youths.' Prosecutor Adrianna Mucciarelli argued for a four-month jail sentence, citing Lannigan's criminal record and mental health issues, noting that he never attempted to report to his probation officer despite available resources. She emphasized the aggravating factor of the indecent act, stating he was 'going around the hospital, exposing himself to medical staff and people waiting in the emergency room,' which was undoubtedly an unpleasant experience for them. Lannigan's lawyer, Eric McCooeye, countered that his client had been released from jail in late October, 'not well at the time,' and 'landed back in custody.' He asserted Lannigan was 'much better today, much more stable and appears to be in a much better place.' McCooeye highlighted Lannigan's arrangements to attend a 30-day program at Northway Wellness Centre and requested a sentence of time served (116 days) to allow for immediate admission. Mucciarelli, acknowledging Lannigan's bed availability at the centre, conceded to the time served proposition. Justice Mendes accepted the joint submission, also imposing a further probation order for 24 months on Lannigan. He remains prohibited from attending SAH except for valid medical reasons and is barred from harassing anyone there.
