“A reverse onus on bail must be created for the offence of possession of a loaded prohibited or restricted firearm in s. 95 of the Code,” the letter states. A reverse onus clause would force someone facing charges to prove why they should be released rather than prosecutors having to prove why they should not be released. It would also go against the government’s view of the justice system and bail, a view which says bail should be the default position.
“When it comes to people who are repeat offenders, for example, and they have a history, a judge should be able to look at that history and make the determination based on that,” Hochul said after her State of the State address.
