As they listen to evidence in the coming weeks, Scrutton asked the jury to consider: “the improbability of coincidence, or, more simply, what are the odds?”are Robert Konashewych, a police constable, and Adellene Balgobin, who worked as a client service representative for an Ontario government agency called the Office of the Public Guardian and Trustee . It manages the financial affairs of people who are incapable of doing so for themselves..
Yet a week after his death, Balgobin noted in the OPGT computer system that a man named “Bob Kay” had contacted her at the OPGT to inform her that Sommerfeld did have a will. Balgobin did not disclose her relationship with Konashewych to anyone at the OPGT, the jury was told. Ultimately, he produced Sommerfeld’s will, purportedly written in 2006, naming him executor and sole beneficiary of his estate, valued at $834,000, Scrutton said. Konashewych applied for probate and received the full amount in the summer of 2018.
