Rochester, N.Y. — The murder conviction of the late James Krauseneck was dismissed this week by a NYS Supreme Court judge.Because Krauseneck had an appeal pending when he died, state law calls for his indictment to be dismissed and his conviction to be tossed out.
Yet, Krauseneck's family still wanted to pursue the appeal and prove his innocence. However, in July, a regional appellate court disagreed and This week, NYS Supreme Court Justice Charles Schiano vacated Krauseneck's conviction because he died in prison while an appeal was pending. The move ultimately shuts out the Krauseneck family from proving James' innocence in the matter.
